Canadian Copyright

Terms and Definitions

QuestionAnswer
Access Copyright A non-profit Canadian licensing agency. It collects revenue from businesses and distributes it back to Copyright owners.
Copyright A form of intellectual property rights. Copyright means that the owner has the sole rights to copy, use, and distribute the product as they choose. Copyright, in Canada, ends 50 years after the calendar year of the owners death.
Intellectual Property Intellectual property refers to the ownership of less tangible things, such as stories, music, art, etc. Intellectual property is protected by copyright.
Royalty The right of the owner of an intellectual property to receive payments based on the use of the property from another party. Payment is usually a percentage of the profit made from the use of the piece of property.
Trade-Marks Trade-marks serve to create a distinction between one company and another, in regards to the goods and services offered.
Public Domain When copyrights are said to have expired a piece or set of work becomes part of the public domain.If a piece of work exists in the public domain moral and economic rights have been lost.
Moral Rights Moral rights protect the creative projects of authors to their own pieces of work, irrespective of who owns the copyright.
Performing Rights Performance rights refers to the right of creators and copyright owners to receive payment for use of their material from other groups performing the copyrighted material in public.
Plagiarism Taking credit for the work of another person, by claiming it as your own or accidentally through incorrect citation/ reference.
Fair Dealing Fair Dealing allows in certain circumstances that a piece of work protected by copyright can be used without the copyright owner's permission.
Patent Patents are used to protect the rights to new developments; however, patents are limited. They do not cover the arbitrary choices in appearance.
Blanket License Blanket licenses cover the ability to legally use a larger group of Copyrighted material, usually granted when individual licensing would be excessive.
